US Court Orders Release of Kilmar Abrego Garcia from Immigration Detention
A federal judge has ordered the prompt release of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement is without legal authority.
"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her ruling.
The case originates in a mistaken removal to El Salvador in March, which US authorities later acknowledged was an error. Following his return to the United States to answer alien smuggling charges, he was held in immigration custody.
In her order, the judge pointed out that the government does not have a valid deportation order, which prevents them from removing Mr. Abrego Garcia "at this juncture."
Context of the Case
The legal challenge center on conflicting assertions. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this allegation.
He has also entered a not guilty plea to the conspiracy charges, which are part of a separate criminal case in the state of Tennessee.
